I work on the same company for 7 years & 10 months already but I wanted to resign to transfer to another job.
I tend my resignation letter last May 13, 2016 stating that i will end my contract this June 14, 2016. At first my boss said he will cancel by June 30, 2016 with a reason that it is not allowed to cancel on mid of month, but I insisted that it was stated in Labour Law that the notice period will be at least 1 month. He got mad, and so he let me signed my cancellation last June 1, 2016 & gave my gratuity. Since our salary is via UAE Exchange, I didn't bother asked about it because I thought he send it in my UAE salary account. When I checked it in UAE Exchange and it's not in there, so I kept on asking about it and he insisted that it is already sent there. With the help of branch manager we found out the He really did not send my salary there only the salary of my co-workers. So, I e-mailed him asking what's the problem with my May compensation, and I got no reply but instead He asked me to give him the office-key. I insisted to not give it to him unless he would give me my passport & answer my email but he asnwered me "okay, you will not give me the key, it's simple". So, that same day (June 7), I check my visa status and I found out that he already cancelled my visa last June 5.
(June 8) I went to tasheel stating about my problem on my May compensation & my cancelled visa, and filed a complaints. I asked if I will still work with a cancelled visa & they said no. So, I emailed my boss about it and asked for my passport. Instead of replying me about my passport he replied (on June 9) saying "your contract is until june 14, i process it on typing center but not yet on immigration. You are illegal now that you are away from work. I will ask my sponsor if he can make a case againsts you and maybe you have ban". But I still didn't went to work because I know He already cancelled my visa and him planning to not let me know.. but instead I went to dubai courts processing my papers for "retrieval of passport" which I can get this wednesday (June 15).
My concern here is, do I have Law Offense of not going to work until June 14, knowing he cancelled my Visa on June 5 in which he did not tell me about this and at the same time he did not give me my May Salary? Am I breaching article 119 of Labour Law? How about Article 121?
