Based on the new Labor Law Regulations for 2016 in an unlimited contract, Job Offers has this particular clause which states on the Eight Article:
"The Second Party acknowledges that it has thoroughly reviewed all the articles stipulated in the Annex enclosed herewith
(7 articles), and he is well aware of all contained provisions and that he has accepted and signed this Offer in the State of
Recruitment or within the UAE"
However this annex also include Article 116:
Article (116) of the Labour Law: Should the Contract be terminated by the
Worker for causes not set forth in Article 121, the Worker shall be bound to
compensate the Employer for the loss incurred thereto by reason of the
termination of the Contract , provided that the amount of compensation does
not exceed the wage of half a month for the period of three months , or for the
remaining period of the Contract , whichever is shorter , unless otherwise
stipulated in the Contract .
Does this mean that even unlimited contract employees are to pay 45 days of their salary when resigning from work?
