I have few questions:-
1)I came from India on employment visa . I was under probation period of 6 months from September 2015 ,i have completed 2 and 1/2 months. I resigned from work on November 19.
a) when i called the labour department they informed that no visa charges or any other payments can be taken from me as i am under unlimited contract. Any terms and conditions can be mentioned in the offer letter but that will not be taken into consideration as it is not registered with the Labour department.
In my offer letter it is mentioned that , i have to pay the company three months salary and visa charges. When i went to the Tasheel office they also say that if i have resigned then i need to pay 3 months salary. Why so much difference in the information given by these two authorities.
which one is correct.
The company paid my salary only the first month on time. The second month salary they delayed and only after my resignation paid during the settlement. They have deducted visa charges of 3925 AED and when i told them about my conversation with the labour department , they showed me the offer letter that i have signed where it is mentioned that they will take three month salary and visa charges.
I have now signed the final settlement, they have also cancelled my employment visa. I have time till the 21st of December to exit the country in the cancellation document. however they are forcing me to exit immediately despite my requests that i want to stay in Dubai . Can they force me to exit. They still have my passport , can they give absconding case against me . They claim that i am their responsibility till i exit. They are literally harassing me. To trouble me can they play around with my passport.
