My name is Nihit Bhatia. I am a Canadian national, I have been employed with an insurance brokerage company based in Dubai on limited contract, with whom I will be completing two years on 28/10/2016.
On 29th of August, I was having a regular conversation with my boss in office, around 5.30 pm. However after a while, the conversation became slightly heated. I was a bit surprised & shocked by my boss’s words, and I felt insulted & humiliated. So around 6pm, I decided to walk out of the office, to avoid any further confrontation with my boss. My boss called my name thrice, but I did not turn back.
The next morning, on 30-8-2016, when I reached office, my colleagues told me that boss has ordered me to sit at reception, as management will decide further. I even wrote an apology letter to my boss, so that I could continue my job. He suggested me to resign otherwise. So far company has not provided me termination letter or any warning letter also. They verbally told me to refrain from my duties.
In addition to this, I have not yet received my CASH salary for the month of August. Our company pays some amount in WPS and other half in cash. In MOL contract only WPS salary is mentioned, but I have receipt for my cash salary.
1). Will I get 6 months or 1 year ban, if employer has terminated me and broken the contract?
2). Do my actions fall under article 120 of UAE labour law as misbehavior, as I neither abused nor physically assaulted my boss?
3). How do I claim my CASH salary from my boss through MOL compliant? Does MOL accept receipts which mention cash salary to employee?
4). What dues should I get from my employer?
5). If the case goes on for long, can I request MOL to cancel my visa and issue temporary work permit?
6). Also can the MOL pass a judgment in my favor over non-payment of wages for more than 1 month? But again WPS has been paid and I am only contesting for my cash salary.
7). My passport is currently in the possession of my employer. Can I request MOL or police or my consulate to get out from the possession of my employer and to be handed back to me?
