Thank you for your initiative to have this forum. Well as in my case, im actually really confused right now. I have already called MOL and got some good response and its all been clear to me but then my company just keep on changing their minds every other day so that makes me unsettled. My case is this.. Im on unlimited contract, done with 3 years this month exactly. My supervisor called me and said they no longer need my position and the company is asking me to stop working on Aug 10, 2016 and they are giving 2-3 months to find a new job and cancel my visa. This conversation happened July 10,2016. On that day i called HR office and ask for a written letter ( means maybe a termination letter)regarding my case and he said he will send it in 2-3 days, I waited no letter came. This week i followed it up coz Aug 10 is nearing. HR told me "speak with ur supervisor not me coz i already told him about u".Speaking with supervisor, he told me "HR told me to let u stay until i come back from vacation or until u find a new job". They keep on insisting that i should get a new job and let them know so they could cancel my visa. I know that anyhow they will terminate me anytime becoz its pretty obvious that my job position is no longer needed. (I am working in a pharmacy as sales staff,they hired a new pharmacist in place of me), they did not renew my medical insurance and not approve my annual leave application. I am not intending to resign but in this case they are forcing me to resign by getting a new job.And by the way, a year before i signed a new offer letter when they transferred me from Dubai to Sharjah work location,stating my salary becomes 3500(i was 4000 aed at the start of contract), so its more than a year Im receiving 3500 salary. Recently when i checked MOL, my contract is still 4000 aed and the exact same contract i have a copy with me.
My questions are:
- What am i suppose to do if they refuse to give termination letter. If i got a new job and let them know so that means i resigned and i terminated the contract right?
2.Regarding end of service/ gratuity pay, i can insist on calculating in MOL contract not on the offer letter i signed?
- Can u compare please compare clearly the benefits of getting terminated and resigned?
- My hire date is July29,2013, my labor contract says July 15, 2013 (emirates ID expiry Aug.4, 2017) Which start date i will calculate my years of service.
