Hello Mr. Deepak,
I was employed with a mainland IT company on a unlimited contract from 7th of December 2016 with a probation period of 6 months.
I have taken 8 days of leave during these 6 months (with no salary cut)as it was allowed to take annual leaves in advance. On 9th of June 2016, my HR manager handed over a termination letter on grounds of financial instability of the company, she also informed me that my probation period has extended by 8 days (as I have taken 8 days leave).
Now during the full and final settlement they have deducted 8 days salary from the total due.
My concerns are:
1) Is probation based on calendar months or it can be extended by employer if employee has taken leaves in the probation period?
2) Incase the leaves are accepted to increase the probation, will they be considered as loss of pay.
