First of all Thank you for inviting to write on this forum.
I have resigned from my present employer and served a notice period for 2 months. After 10 days of acceptance all of a sudden the employer stopped my services and as i belong to the hotel industry this is a very crucial time for both.
Further he refuse to pay for any settlement as i have completed 1 year and 2 months in the same company and they refused to pay for a) leave salary , b) notice period salary.
I have been to the immigration as well as we have a immigration visa. according to the officer as well i am eligible for all of it but still the employer doesnt accept and want to fight for a case.
There is no such department as HR in the company who is responsible for any of the same. In case if any associate or manager wants to stop the services in that case the employer insist and 2 months salary plus the visa charges however when it comes to such situation that some one wants to leave then the employer doesnt do the settlement and pay for only the no. of days worked.
I was managing a big department and was at a crucial stage that why didnt want to risk any business at risk and spoil the relationship.
I have a copy of contract, copy of resignation acceptance and a mail which i sent with details of how much the total its working out in case of dismissal of service at such time.
Please give you inputs as presently looking for jobs and there is no settlement as well. and i want to fight a case as this is a big money. I was ready for compromise as per the Company's PRO as well what he suggested however the employer still want to create problem. It goes without saying that he has enough to waste but not to give.
