i am working in a llc company on civil engineer visa since May 2010, on unlimited visa.
Last year while availing annual leave, my employer did not pay me the annual leave salary citing reason that I had taken more unpaid leaves (like emergency leaves in which I had to go to my home country, for which company has treated as unpaid leaves and not paid salary for those number of days) and will not be counted in the service period of one year.
My question is while calculating service period of one year (12 months or 365 days), does that unpaid days deducted and the employee has to work those number of days extra to avail annual leave?
Eg. In the 2nd year of service, an employee was not in the country (while same was informed to the employer and upon approval) for 10 days, does the service period get extended by 10 days.
