Thanks for sharing UAE labor Law. I have one query - we have terminated one employee under non-performance grounds, for which we have a mail received from client on the same. We gave him many chances to prove his skills, unfortunately he failed in all attempts.
Since, he was under probation period (worked for one month only), we sent a mail of terminating his service. we booked a ticket for his India travel on the same day, which he rejected & asking for the settlement of his salary.We had to face many liabilities for his Visa processing, tickets, accommodation & travel advance. Mainly the rapport which was built with the client has ruined. We are not asking employee to repay anything.
We are yet to cancel his work permit as well.
In such scenario, I need to know
- Whether we have to pay salary or settlement to employee?
- Book a ticket for him again to return his country & cancel the work permit?
- Since he is not ready to move from Dubai untill we settle his dues, can I get any suggestion from you to send him to his country?
- What are the legal stand I can have to terminate a employee under non-performance grounds, who is under probation & without paying any remuneration.
