I work as Sr. Engineer in a consultancy company in Abu Dhabi.
My emplyer has given me termination letter two days ago, soon after I returned from my annual leave stating that they dont have work now and for nex few months.
Now they are forcing me to avail all my annual leaves (14 days) immidiately. I do not wish to take the same.
They are refering to Labour Law article 76 stating that they have right to send me on annual leave as they dont have work.
Our company Personal Instruction (PITS) guide books states the following:
4.6 In the event of termination of the contract based on either the request from company or employee, the employee is entitled to compensation of unconsumed leave (positive leave balance) in cash, based on basic salary only calculated on yearly working hours.
4.7 In the event of an employee having a negative leave balance at time of termination or resignation, the leave will be recovered in the final accounts against the full salary (See PIT Table 8.1).
Please advise what can I do.
