I hope you can give us some advice regarding my sister's current ordeal. My sister has been working in a restaurant for almost a year now but on 5th of January, she was given a termination letter which states that due to closure of the restaurant, they have to terminate her. However, since my sister is very hardworking, her manager talked to her and told her that the managament decided to keep her but she will be working with another restaurant that they also own. On 6th of January, my sister accepted what her bosses are offering her hence she signed a new company offer letter. From 6th till 13th pf January, my sister was still asked by her manager to come to work to the restaurant where she was terminated. When my sister asked why, they said it's fine because both are being owned and sponsored by the same person. Now, on 14th of January, my sister was asked to come to that other restaurant and so surprised to found out that her shift will be 12.5 hrs. Pls note that the number of working hours is not stated on the offer letter so my sister decided to back out. She immediately informed her manager as soon as she comes home that she will not continue anymore but her manager is threatening her that they will put a 6 months to 1 yr ban on her.
The visa of my sister from the old restaurant is still valid and not yet cancelled. Her visa for the new restaurant has not been processed as well. We talked to her manager and asked them to juat honor the cancellation since no new visa has been applied to her yet but they're telling her that they terminated one employee so my sister can replace her and they suffered a company loss because of her. Is that a possible ground for a company to put ban on their employees? They're even forcing her to submit a resignation letter for them to process her cancellation which she did not did because she said that she was already terminated in the first place and what she signed is only an offer letter from the company and not from MOL.
Now, my sister did not come to work anymore and is planning to talk to her manager after 2 weeks thinking that everything will not be as bad as the first time they talked. But her manager told her that they will file a complaint in Labor for absconding since she did not come to work after they talked. My question is, what do you think is the best thing we should do so we can settle this with them? My sister is okay not to be paid anymore so long as they will not put ban on her.
