I am currently working in Abu Dhabi in a private Hospital on a senior Managerial position. I have resigned from my current employer and was supposed to relinquish employment with them on 10th Jan 2016. However, they have not accepted my resignation and I told them in good will I will extend my employment with them until the end of this month to ensure smooth handover of work. I have just received an employment offer and contract to be signed from a reputed facility operating in private sector. I have couple of queries regarding the offer and contract and would really appreciate if you can help me with the same:
1. Job Offer Letter: There is no mention of the duration of the employment contract (fixed or non-fixed) in the offer letter.
2. Contract Termination: The termination clause states that if the employee terminates the contract for reasons other than those provided for under Article (120) hereof U.A.E. Labour Law, the employee becomes liable for compensating the employer against losses by paying the employer half a month’s pay for a period of three months or for remaining period of the contract whichever is shorter. However there is no termination clause in the agreement (in compliance with Article (115) in the previous Labour Law) which states that if the employer terminates the contract for reasons other than those provided for under Article (121) hereof U.A.E. Labour Law, the employer becomes liable for compensating the employee by paying full salary for a period of three months or for remaining of the contract whichever is shorter.
3. Notice period: The agreement clause states that either party shall terminate the contract by giving a three months notice to the other party or compensation in lieu of.
4. Probation Period: Clause states that should the employee resign during its probationary period, the organization reserves the right to deduct half month’s pay for a period of three months from the employee’s final settlement amount. However there is no such obligation for the employer to pay to the employee. As I understand either party can resign during the probationary period without having to pay to the other party.
Please shed some light over this and correct me If I am wrong in being concerned with the Agreement and offer. They are pushing me to expedite the paperwork asap. Would really appreciate your feedback on the aforementioned.
