Currently I am working in Abu Dhabi with a WLL company since October 2003 on an unlimited contract. My current Job position is Accounts manager. But I didn't receive any formal Job responsibility or any other document to backup my position. It is only a verbal instruction from the owner of the company. But my email and business card is of an accounts manager.
Initially my visa was under another firm of the same expatriate sponsor , but with a different Local sponsor.However I was working in the same company and same office. Previous firm was an establishment,but almost in the same name of my current firm. Initially my salary as per labour contract was 4425 (Basic 3000 + Other allowances +1000 + EOS 175 + Leave salary 250 ). It shows my EOS and leave salary was included in labour contract.
Since 06-09-2012 my visa changed to the current company (WLL) with a unlimited contract and with a salary of 8500 (Basic 3000 + HRA 3000 + Transportation 2000 + Leave Salary 250 + EOS 250). However my actual salary was more. Now my actual salary is AED 11834 (11000 fixed with no proper break up + 417 Leave salary + 417 EOS) which is monthly transferring to bank and I am getting HRA AED 50000/ year which I a getting as cheque of 25000 on every six months.
But I under stood that even EOS is mentioned in labour contract , the UAE labour law will not accept it since EOS means to be paid at the end of service.
Now my questions are; if a resigns or terminated will I get any EOS benefits?. Even at the time of changing my visa I didn't get anything.On normal yearly vacations also the company is not paying anything since it is already included in my monthly salary as per labour contract. If I am eligible pay EOS how it will be calculated. It is as per my full salary without HRA 11000 or as per labour contract basic salary of 3000. Kindly reply.
